Ignition Interlock Laws

  • Montana ignition interlock laws require an ignition interlock device for a driver to regain limited driving privileges if he or she is a repeat offender.
  • First-time offenders are typically not required to install an interlock device in order to apply for reinstated driving privileges.
  • An interlock device may be required at the discretion of the court even for first-time offendersdepending upon the circumstances of the offense.

License Suspension

Administrative Suspension

Montana DUI laws state that drivers who are stopped for suspicion of DUI are required to take a field sobriety test. If the driver fails or refuses to take the test, he or she is subject to an immediate administrative license suspension of one year.

Judicial Suspension

In addition to the administrative suspension, drivers who are convicted of DUI face a court-ordered license suspension. The term of this suspension is six months for a first offense and one year for second and third offenses.
